Terms of Use – MedSpa.us

  1. Acceptance of Terms

MedSpa.us offers a variety of online resources and services, including professional listings, classified ads, forums, catalogs, email communications, and other features (collectively, the “Service”). By accessing or using any part of MedSpa.us, you agree to comply with these Terms of Use (“TOU”). Additional rules or guidelines may apply to specific sections of the Service, and by using those areas, you also agree to follow those guidelines. If you do not agree with any portion of the TOU or any updates, your only option is to immediately stop using the Service.

  1. Changes to Terms

MedSpa.us may revise or update these TOU at any time. All modifications are effective immediately upon posting. You are responsible for regularly reviewing the TOU to stay informed about any updates. Continued use of the Service constitutes acceptance of any changes.

  1. Eligibility

Certain features of MedSpa.us may be reserved for professional users, including licensed practitioners, sellers, collectors, and service providers approved by MedSpa.us. While we attempt to limit access to these users, we cannot guarantee full compliance and assume no liability if non-professional users access restricted areas.

  1. User Content

You are fully responsible for any content you post, upload, or otherwise make available through MedSpa.us, including text, images, videos, and other materials (“Content”). By posting Content, you grant MedSpa.us a worldwide, perpetual, irrevocable, non-exclusive license to use, display, reproduce, and distribute your Content across the Service and related platforms, including promotional uses.

MedSpa.us does not pre-screen Content but reserves the right to remove or refuse any Content at its discretion. You acknowledge that MedSpa.us is not responsible for the accuracy, reliability, or legality of user-generated Content.

  1. Third-Party Content

The Service may contain links to or references to third-party websites, products, or services. MedSpa.us is not responsible for any interaction you have with these third parties, including payment, delivery, quality, or legality. Any disputes with third parties are solely between you and the third party.

  1. Intellectual Property Infringement

If you believe your copyrighted work or other intellectual property rights are being violated on MedSpa.us, please submit a notice to contact@infoempire.com including:

  • Identification of the infringing material;
  • A statement of good faith belief of infringement;
  • Your contact information;
  • A declaration of accuracy under penalty of perjury;
  • Your signature (electronic or physical).
  1. Privacy and Data Use

MedSpa.us may collect and store your data, including emails, IP addresses, and other information, as outlined in our Privacy Policy.

  1. Prohibited Conduct

You agree not to post or share content that is:

  • Illegal, harmful, abusive, or offensive;
  • Pornographic or sexually explicit;
  • Discriminatory based on race, gender, religion, sexual orientation, age, disability, or other protected categories;
  • Fraudulent, deceptive, or misleading;
  • In violation of intellectual property rights;
  • Spam, unsolicited advertising, or chain letters;
  • Disruptive to MedSpa.us infrastructure.

You also agree not to:

  • Harass or stalk other users;
  • Collect personal data without consent;
  • Use automated tools without permission;
  • Post the same content repeatedly;
  • Attempt unauthorized access to the Service.
  1. Posting Agents

Only approved Posting Agents may post Content on behalf of others. Unauthorized use of Posting Agents is prohibited.

  1. No Spam Policy

Sending unsolicited emails or advertisements through MedSpa.us systems is strictly prohibited. Violations may result in legal consequences.

  1. Fees and Paid Services

Certain areas of the Service may require a fee to post or access Content. Fees are non-refundable unless explicitly stated in writing.

  1. Limitations on Service

MedSpa.us may set limits on the amount, size, and duration of Content or messages, and may suspend or discontinue any part of the Service at its discretion.

  1. Access License

You are granted a limited, revocable, non-exclusive license to access MedSpa.us for personal, non-commercial purposes. Any use beyond these limits requires written permission from MedSpa.us.

  1. Termination

MedSpa.us may terminate your access at any time for violations of the TOU, without liability. Termination does not release you from responsibilities under these Terms, including indemnity and payment obligations.

  1. Proprietary Rights

All content, design, and materials on MedSpa.us are protected under copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute Content without permission.

  1. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, including but not limited to accuracy, reliability, or fitness for a particular purpose.

  1. Limitation of Liability

MedSpa.us is not liable for direct, indirect, incidental, consequential, or special damages arising from your use of the Service or reliance on Content.

  1. Indemnification

You agree to defend, indemnify, and hold MedSpa.us harmless from any claims, damages, or legal expenses arising from your use of the Service or violation of the TOU.

  1. Governing Terms

The TOU constitute the full agreement between you and MedSpa.us. Any disputes must be brought within one year of the event giving rise to the claim.

  1. Liquidated Damages

Certain violations of the TOU may incur liquidated damages as outlined in the full TOU. MedSpa.us may also seek injunctive relief to enforce the TOU.

  1. Programs and Services

MedSpa.us provides access to programs connecting consumers with professionals. MedSpa.us and its affiliates are not parties to agreements between users and professionals and disclaim liability for any engagement, service, or dispute.

  1. Brand Account Agreement

By accessing your MedSpa.us account, you agree that you have the legal authority to represent your brand and grant MedSpa.us the right to display product information, images, pricing, and related materials. Membership fees are billed automatically, and accounts may be terminated by either party in accordance with these terms.
